DEMAND TO TAKE DOWN VIDEO
Sir/Madam:
We write on behalf of our client, TRISHA MAE M. GONZALES, a mother of a minor.
Our client found out that the videos of her minor daughter involved in a sexual conduct has found to have been circulating in your website.
Pursuant to our special laws protecting minors and children specifically Republic Act No. 11930 read as follows:

Section 2. Declaration of Policy. — The State recognizes the vital role of the youth in nation-building and shall promote and protect their physical, moral, spiritual, intellectual, emotional, psychological, and social well-being. Thus, it is the policy of the State to provide special protections to children from all forms of sexual violence, abuse and exploitation especially those committed with the use of information and communications technology (ICT), provide sanctions for their commission and carry out programs for the prevention, deterrence and intervention in all situations of online sexual abuse and exploitation of children in the digital and non-digital production, distribution or possession of child sexual abuse or exploitation material.

Section 4. Unlawful or Prohibited Acts. — Regardless of the consent of the child, it shall be unlawful for any person to commit the following acts through online or offline means or a combination of both:

(g) To stream or live-stream acts of, or any form of, child sexual abuse and exploitation;
xxx
(n) To sexualize children by presenting them as objects of sexual fantasy, or making them conversational subjects of sexual fantasies, in any online or digital platform;

(r) To possess any form of online sexual abuse or exploitation of children (OSAEC): Provided, That possession of three (3) or more CSAEMs is prima facie evidence of the intent to sell, distribute, publish or broadcast;

Based on the above, we demand that the following videos with URLs indicated below be taken down and a report of such action will be communicated to us the soonest time possible.

In view of the foregoing, a FORMAL DEMAND is hereby made upon you to take down the videos indicated by the URLs and all other related videos you have on the site, otherwise, our client shall be constrained to file the appropriate action against you.
