Good day Ma'am/Sir,
This is the Women and Children Cybercrime Protection Unit of the Philippine National Police Anti-Cybercrime Group.
This pertains to the investigation being conducted by this Group on a violation of Republic Act No. 9995 also known as the “Anti-Photo and Video Voyeurism Act of 2009” which provides for the prohibition of acts stated in Section 4 (b), (c), and (d) notwithstanding the victim’s consent to record and take the photo or video coverage, to make a copy or reproduced and to sell or distribute, or cause to be sold or distributed such photo or video or recording of sexual act in which they have a reasonable expectation of privacy. The penalty of imprisonment of not less than three (3) years but not more than seven (7) years and a fine of not less than One hundred thousand pesos (P100,000.00) but not more than Five hundred thousand pesos (P500,000.00), or both, at the discretion of the court shall be imposed upon any person found guilty of violating Section 4 of this Act.
Facts of the Case: The explicit videos were illegally posted by an unknown perpetrator to multiple porn sites. Please be informed that the person in the picture/video reported and did not consent to uploading the materials.
